1. end-user license agreement

This End User License Agreement (the "Agreement" or "EULA") is a legal agreement between you — the individual or legal entity installing or using the software — and Ayhan Dogan, operating under the name AySound ("AySound", "we", "us", "our"). It governs your use of the AySound audio plugins — currently AyLimiter, AyCompressor, AyEQ, AyDeEsser, AyGate, AyClipper, AySaturator, AyWidth, AyGain, AyDelay and AyVerb — together with the AySound Suite installer, the individual plugin archives, the bundled factory presets, and any updates or new versions we may make available (collectively, the "Software").

By downloading, installing, copying, or otherwise using the Software, you confirm that you have read this Agreement, that you understand it, and that you agree to be bound by its terms. If you do not agree with any part of this Agreement, do not download, install, or use the Software, and delete any copies you may already have. If you are accepting this Agreement on behalf of a company or another legal entity, you represent that you have the authority to bind that entity, and "you" refers to that entity.

This Agreement applies to every copy of the Software, regardless of how you obtained it, and remains in effect for as long as you use the Software or until it is terminated as described in section 6.

2. license grant, permitted use and restrictions

Subject to your compliance with this Agreement, AySound grants you a free-of-charge, perpetual, non-exclusive, non-transferable, worldwide license to install and use the Software on any number of computers that you own or control. The license covers both personal and commercial use without distinction: you may use the Software in hobby projects, client work, commercial releases, film and game scores, broadcasts, streams, live performances, and any other lawful audio production, without paying royalties, license fees, or any other compensation to us, and without crediting AySound (although credits are always appreciated).

Everything you create with the Software belongs entirely to you. Audio that has been processed through the Software — recordings, mixes, masters, stems, bounces, or any other rendered material — is your work, and this Agreement gives AySound no rights of any kind in it. Likewise, presets you create and save with the Software are yours; you may share them freely, including commercially.

You may make a reasonable number of backup copies of the installers and archives for your own archival purposes, and you may reinstall the Software on replacement machines at any time. Within a studio, educational institution, or company, the Software may be installed on shared machines used by several people, provided each user's use complies with this Agreement.

The license above is subject to the following restrictions. You may not:

sell, rent, lease, sublicense, or otherwise charge money or any other consideration for the Software itself, in whole or in part;
redistribute the installers, plugin binaries, or factory presets publicly — for example on download portals, file-sharing platforms, or bundled with other products — without our prior written permission; if you want to point others to the Software, link to our official download page instead, so that everyone receives the current, unmodified version;
modify, adapt, translate, decompile, disassemble, or reverse-engineer the Software, or create derivative works based on it, except to the extent such a restriction is expressly prohibited by applicable law;
remove, obscure, or alter any copyright notices, trademarks, version information, or other proprietary markings contained in the Software;
present the Software, the AySound name, the aysound wordmark, or the moon logo as your own work, or use them in a way that suggests an endorsement or affiliation that does not exist;
use the Software to develop a competing product by systematically copying its user interface, signal-processing behaviour, or preset content.

Journalists, reviewers, and content creators are welcome to show the Software in articles, videos, and streams — screenshots and screen recordings of the plugins are expressly permitted for this purpose; official material is available on our press page.

3. installations, updates and support

The Software requires no account, no online activation, no license file, and no hardware dongle. It does not limit the number of machines or simultaneous instances, and it never connects to the internet: there is no telemetry, no usage tracking, and no phone-home mechanism of any kind. Details on how we handle data are described in our privacy policy, which forms part of the overall picture but is not part of this Agreement.

We may release updates and new versions of the Software at our discretion. Updates are published on our download page and documented in the changelog; installing an update over an existing installation preserves your presets and settings. Unless an update is accompanied by its own license terms, this Agreement applies to all updates and new versions. We are under no obligation to provide updates, new features, or continued compatibility with any particular operating system or host application, although we care about all of these things.

Support is provided on a goodwill basis by e-mail at aysound@ayhandogan.com.tr. We aim to answer within one to two working days, but response times are not guaranteed and support is not a contractual entitlement. Answers to the most common questions can be found in the support section.

4. price and distribution

The Software is provided completely free of charge. There are no trial periods, no feature limitations, no watermarks, and no obligation — now or in the future — to pay, donate, register, or subscribe in order to keep using it. Should AySound ever release paid products, this free license for the Software you have already downloaded remains unaffected.

The only official source for the Software is aysound.ayhandogan.com.tr. Copies obtained from other sources may be outdated or tampered with; we can only vouch for files whose SHA-256 checksums match those published on our download page. This Agreement grants no rights whatsoever to third parties who distribute the Software in violation of section 2.

5. no warranties; limitation of liability; indemnification

The Software is provided "as is" and "as available", free of charge, and without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Software will be uninterrupted, error-free, or compatible with every system, host application, or workflow, or that defects will be corrected. You are responsible for maintaining backups of your projects and data; audio software operates in complex host environments, and you use the Software at your own risk.

To the maximum extent permitted by applicable law, AySound shall not be liable for any indirect, incidental, special, consequential, or exemplary damages — including lost profits, lost revenue, lost data, corrupted sessions, missed deadlines, or business interruption — arising out of or in connection with the Software or this Agreement, even if we have been advised of the possibility of such damages. Because the Software is free of charge, our total aggregate liability under this Agreement shall in any event be limited to the amount you paid for the Software, which is zero, except where such a limitation is not permitted by law.

Nothing in this Agreement excludes or limits liability for intent or gross negligence, for injury to life, body, or health, under mandatory product liability law, or for any other liability that cannot be excluded or limited under applicable law. Statutory rights that you have as a consumer remain unaffected.

You agree to indemnify and hold harmless AySound from any claims, damages, and reasonable costs (including legal fees) brought by third parties to the extent they arise from your use of the Software in violation of this Agreement or of applicable law.

6. term, termination and miscellaneous

This Agreement is effective from the moment you first download or install the Software and continues until terminated. It terminates automatically and without notice if you breach any of its terms; in that case you must cease all use of the Software and delete all copies in your possession. Sections 5 and 6 survive any termination. Audio you created with the Software before termination remains yours.

We may amend this Agreement for future versions of the Software; the version of the EULA published on this page at the time you download a given copy applies to that copy. The date at the top of this page always indicates the current revision.

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision shall be replaced by a valid one that comes closest to its economic intent. This Agreement constitutes the entire agreement between you and AySound regarding the Software and supersedes any prior communications on the subject. A failure to enforce any provision does not constitute a waiver.

This Agreement is governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which you habitually reside remain unaffected.
